Although we won according to the rules as set
out by the Kinnelon Board
of Adjustment, it appears that we the residents
are to ultimately be
sold out by that same board. Sprint has filed
an appeal, with the state
of NJ in Morristown, to reverse the decision
of the Board of
Adjustment, not to granting them the variances
they need to erect a commercial cell
tower on residential property. The Kinnelon
Board has decided that they
will not defend the appeal (the cost to the
town would only be $5-$8
thousand). By not defending they will virtually
be giving Sprint the
right to go ahead.
If you believe in the democratic system this
process would really shake
your belief. First, you at your own expense
have to hire lawyers and
expert witnesses to defend your position, this
costs tens of thousands
of dollars (the town did not support this effort
several neighbors did
and I thank them). Then they have to match up
against Sprint's gang.
Even though we were out numbered and out financed
we won (not). After
we the citizens had been dismissed Sprint appealed
the decision, here is
where the real communist, non-representation,
back room politics, takes
place, there is another vote. The Board of Adjustment
gets to vote to
defend or not to defend the appeal. Our spineless
group of appointed
members voted not to defend, thereby selling
out the residents who
spent over 22 months in public hearings and
winning according to the rules.
Attached is
a letter which I have delivered to the residents
on Whitty
Road we need your help to call our elected officials
and have them tell
the Board of Adjustment that we want the variance
rejections defended.
